Terms of Service

Welcome to TrustVitals, a mobile application provided by Let's Talk Interactive, Inc. ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the TrustVitals app ("App"). By downloading or using the App, you agree to these Terms.

1. Use of the App

TrustVitals is designed for use by patients whose healthcare providers are enrolled in the TrustVitals platform. The App enables users to capture and upload digital biometric data (such as heart rate and blood pressure) to be referenced during virtual or in-person healthcare visits.

You may only use the App if:

• You are 13 years of age or older
• You have been invited or instructed to use the app by a participating healthcare provider
• You agree to comply with these Terms and all applicable laws

2. Account and Access

You may be required to log in to access features of the App. You agree to:

• Provide accurate and complete information during registration
• Maintain the security and confidentiality of your login credentials
• Notify us immediately of any unauthorized use of your account

3. Data and Privacy

Use of the App is subject to our Privacy Policy which explains how we collect, use, and share personal data. By using the App, you consent to the collection and processing of your biometric and usage data as described in the Privacy Policy.

4. No Medical Advice

The TrustVitals app does not provide medical advice. The biometric data captured by the App is made available to your healthcare provider for informational purposes only and is not a substitute for professional medical diagnosis, advice, or treatment.

Always consult your healthcare provider for any medical concerns.

5. Payments

The App is provided free of charge to patients. Any payment for services is handled externally between healthcare provider organizations and Let's Talk Interactive, Inc. The App does not offer in-app purchases or charge users directly.

6. Intellectual Property

All content, features, and functionality in the App are the property of Let's Talk Interactive, Inc. and protected by intellectual property laws. You may not copy, distribute, or modify any part of the App without our prior written consent.

7. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Reverse engineer or attempt to extract the App's source code
• Upload malicious code or disrupt the operation of the App

8. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users or us.

9. Disclaimers and Limitation of Liability

The App is provided "as is" and "as available." We do not guarantee that the App will be error-free or uninterrupted. To the fullest extent permitted by law, we disclaim all warranties and are not liable for any indirect, incidental, or consequential damages related to your use of the App.

10. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law principles. Any legal action must be brought in a court of competent jurisdiction located in Charlotte, NC.
